Welcome to MyCulture, a software-as-a-service (SaaS) platform developed by Happily.ai and operated by DHA Siamwalla Limited, located at 202 Surawong Road, Bang Rak, Bangkok 10500 (referred to as "we", "us", or "our" in these terms). These Terms & Conditions govern your access and use of the MyCulture platform and any associated services offered through the platform (referred to collectively as the "Services"). By accessing or using the Services, you agree to be bound by these Terms & Conditions.

Use of Services
You may use the Services only in compliance with these Terms & Conditions and applicable laws and regulations. You agree not to use the Services for any unlawful purpose, or in any way that would violate these Terms & Conditions. We reserve the right to terminate or suspend your access to the Services at any time, with or without notice, for any reason, including without limitation, breach of these Terms & Conditions.

Your Account
In order to access certain features of the Services, you may be required to register and create an account. You are responsible for maintaining the confidentiality of your account information, including your login credentials and any other information associated with your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

Payment and Subscription
Some Services may require payment of a fee or subscription. By subscribing to any Services, you agree to pay the fees associated with that subscription. Fees may be subject to change at any time. All fees paid are non-refundable.

IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS & CONDITIONS OR THE USE OR INABILITY TO USE THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY.

Indemnification

We reserve the right to modify these Terms & Conditions at any time, in our sole discretion, by posting updated terms on the MyCulture platform. Your continued use of the Services after such modifications shall constitute your acceptance of the updated Terms & Conditions.

Termination
We may terminate or suspend your access to the Services at any time, with or without notice, for any reason, including without limitation, breach of these Terms & Conditions.

Miscellaneous
These Terms & Conditions constitute the entire agreement between you and us with respect to the subject matter hereof and supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and us. If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions shall be enforced to the fullest extent possible, and the remaining provisions of these Terms & Conditions shall remain in full force and effect.
